Bathroom Showrooms Terms & Conditions – MP Moran & Sons Limited
Thank you for choosing to use MP Moran & Sons Limited. These terms and conditions govern your use of our showroom, and any purchases you make from us. By accessing our showroom or making a purchase, you agree to these terms and conditions.
Definitions
Stocked Products: Products that are currently stocked in our stores.
Non-Stocked Products: Products that are not actively stocked in our stores. These are denoted with an asterisk (*) on a sales order and quotation.
1. Product Information
1.1. All product descriptions, images, dimensions, and specifications provided by MP Moran & Sons Limited (hereinafter referred to as “the Company”) are for guidance only and may be updated or corrected without prior notice.
2. Pricing and Payment
2.1. Prices are quoted in GBP and exclude VAT unless stated otherwise. Full payment is required before delivery or collection, unless otherwise agreed in writing.
2.2. The Company reserves the right to adjust prices to reflect changes in supplier costs, duties, taxes, or other surcharges that may apply after the date of quotation. The Company reserves the right to correct pricing errors at any time, including after the issuance of an invoice.
2.3. Payment methods include cash, credit/debit card, or bank transfer. Corporate credit card payments may incur a surcharge of 2%.
2.4. All orders paid using an MP Moran & Sons Limited credit account will be subject to the Companies credit terms.
3. Orders and Delivery
3.1. Orders are subject to stock availability and Company acceptance. The Company shall not be bound by any order until payment in full has been received.
3.2. Delivery dates and times are estimates only, and the Company shall not be liable for delays nor for any costs, damages, or losses incurred by the Customer as a result of such delays.
3.3. Goods must be accepted within 21 days of the notified delivery date. Failure to do so may result in storage charges of 5% of the order value per month. Orders not accepted within 6 months will be deemed fulfilled, and the Company may resell the goods.
3.4. Deliveries are kerbside only. The Customer is responsible for ensuring suitable access and handling arrangements. The Company is not liable for delays. The Company reserves the right to charge a re-delivery fee of £16.50 plus VAT should a delivery by unsuccessful.
4. Returns, Refunds, and Cancellations
4.1. Stocked products will only be considered for return within 28 days of purchase, provided they are unused, undamaged, and in their original packaging with all parts and instructions. The Company reserve the right to charge a restocking fee of 15% of the total order value.
4.2. Non-stocked products are non-refundable and non-cancellable.
4.3. Any damaged, misdelivered, or incorrect items must be reported to the Company within 48 hours of delivery. Once installed, products cannot be refunded.
4.4. If a fault appears within 12 months of purchase under normal use and is confirmed by the supplier, the Company will provide a replacement item. Refunds will be processed within 28 days of inspection and approval. Return shipping costs are the Customer’s responsibility unless the item is faulty.
4.5. Care instructions for products are provided inside the packaging of each item. The Customer is responsible for reading and adhering to these instructions. The Company shall not be liable for any damage or deterioration resulting from the Customer’s failure to follow the provided care instructions. Additional copies of care instructions may be obtained from the manufacturer’s website or by contacting the Company directly.
4.6 While the Company provides detailed guidance and recommendations regarding the products it supplies; it cannot be held responsible for the suitability of the goods for specific installations. This is because complete installation requirements cannot be fully assessed at the time of sale. It is the responsibility of the Buyer and/or their installer to confirm that all purchased items and fittings are appropriate for the intended use and installation.
5. Warranty
5.1. Products are covered by the manufacturer’s warranty. Claims must be upon discovery with proof of purchase. The warranty excludes damage from misuse, improper installation, or wear and tear. Manufacturers warranties are provided within the packaging of each item. Alternatively, you can obtain these through the manufacturers website or by contacting the Company directly.
6. Liability
6.1. The Company shall not be liable for indirect, incidental, or consequential losses. Liability is limited to the value of the product(s) purchased.
7. Governing Law and Jurisdiction
7.1. These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
